Terms of Service
Effective 8 July 2026
These terms are an agreement between you and [REGISTERED BUSINESS NAME] (ABN [ABN]), trading as Daimo ("Daimo", "we", "us"). By creating an account or using the Daimo app or website, you agree to them.
1. What Daimo is — and what it isn't
Daimo generates draft Safe Work Method Statements (SWMS) and Job Safety Analyses (JSA) from your description of a job, using a curated library of hazards and controls for licensed trades in Queensland. Daimo is a documentation tool. It is not a safety consultant, not legal advice, and no output is certified, approved, or endorsed by WorkSafe Queensland, the Electrical Safety Office, the QBCC, or any regulator.
Your responsibility under the WHS Act. Every document Daimo produces must be reviewed, adapted where necessary, and signed by the responsible person before work commences. As the person conducting a business or undertaking (PCBU), you remain responsible for the accuracy and suitability of your safety documents under the Work Health and Safety Act 2011 (QLD). Daimo can only work from what you tell it — if the job description is incomplete or inaccurate, the document will be too.
2. Your account and your team
- You must provide accurate business details (including your ABN and trade licence number) and keep your login credentials secure.
- Business owners can create logins for employees up to their plan's seat limit. You're responsible for your team's use of Daimo.
- You must hold the appropriate licence for any licensed work your documents describe.
3. Plans, billing and document allowances
- Prices are in Australian dollars. Monthly plans bill on the same date each month; annual plans bill yearly at a discount.
- Each plan includes a monthly document allowance shared across your whole team. Your allowance renews each month on the day of the month you subscribed, and unused documents do not roll over.
- When an allowance is used up, document generation pauses until it renews — or you can upgrade at any time.
- New accounts receive a small number of free documents to trial the service.
- We may change prices or plan inclusions with at least 30 days' notice; changes apply from your next billing period.
4. Cancelling and refunds
You can cancel any time by emailing hello@daimo.com.au — cancellation takes effect at the end of your current billing period, and you keep access until then. Nothing in these terms excludes your rights under the Australian Consumer Law, including consumer guarantees that cannot be excluded. Where a refund is required by law, we'll provide it.
5. Fair use
- Use Daimo only for lawful purposes connected with your own business's work.
- Don't resell, redistribute, or offer Daimo's output as a template service to others.
- Don't represent a Daimo document as certified or regulator-approved.
- Don't attempt to copy, reverse-engineer, or misuse the service, or share accounts beyond your plan's seats.
6. Ownership
The documents you generate are yours. The Daimo software, hazard and control library, and branding remain ours.
7. Liability
To the maximum extent permitted by law (and always subject to the Australian Consumer Law), Daimo's total liability arising out of the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing in this clause limits your own duties, or ours, under work health and safety law — and clause 1 (your responsibility for safety documents as PCBU) always applies.
8. Your data
How we handle your information is set out in our Privacy Policy. Keep your own exported copies of signed documents — WHS record-keeping obligations (for example, retaining a SWMS until the work is complete, or longer after a notifiable incident) are yours.
9. Changes and ending the service
We may update these terms with notice by email or in the app; continued use after notice is acceptance. We may suspend accounts that breach these terms. If we ever discontinue Daimo, we'll give you reasonable notice and time to export your documents.
10. Governing law
These terms are governed by the laws of Queensland, Australia.
